Imunita členů Evropského parlamentu

Imunita členů Evropského parlamentu je zakotvena v Protokolu o výsadách a imunitách ES z 8. dubna 1965. Podobně jako vnitrostátní úpravy v jednotlivých členských státech zahrnuje neodpovědnost za názory vyslovené v souvislosti s výkonem funkce a dále nestíhatelnost v rozsahu, která náleží představitelům národního parlamentu. I přes setrvalé snahy Evropského parlamentu "aktualizovat" platnou úpravu a odstranit z ní národní rozměr nebyl Protokol dodnes změněn. Přesto se nedá říci, že by byl institut parlamentní imunity rigidní a nijak se nevyvíjel. Rozhodování o zbavení nebo ochraně imunity patří k pravidelné agendě Výboru pro právní záležitosti i pléna Evropského parlamentu. Některé posuny ve výkladu parlamentní imunity jsou zřetelné ze zpráv, kterými se výbor vyjadřuje k jednotlivým žádostem, jiné dovodíme ze změn Jednacího řádu Parlamentu. K výkladu platné úpravy parlamentní imunity a vymezování mantinelů její aplikace výrazně přispívají i evropské justiční orgány.

Immunity of Members of the European Parliament

The immunity of members of the European Parliament is based on Protocol on privileges and immunities from April 8, 1965. Inspired by national regulations, the Protocol lays out provisions on non-liability (covering opinions expressed or vote cast during debates in Parliament) and inviolability (under same conditions, as the members of national parliaments are protected). Since eighties, the Parliament has struggled for a revision of the Protocol unsuccessfully. The revision should overcome the national extension of the Protocol and "upgrade" provisions, concerning the members of Parliament. Even if the Protocol text has not been revised yet, we cannot say that the institution of parliamentary immunity is rigid, or that it has not changed at all. Decisions concerning the parliamentary immunity belong to routine agenda of Committee for legal affairs and the plenary assembly of European parliament. Some shifts in the interpretation and application of parliamentary immunity may be identified in reports of the committee dealing with particular request for defence or waiver of the immunity, other result from the changes of Rules of procedure of the European Parliament. European judicial institutions also contribute to the interpretation of parliamentary immunity and define the frame of its application substantially.
